Answers to what clients ask us most

Straightforward guidance on conveyancing, deceased estates and our fees — because a legal matter should never feel like a mystery.

A Letter of Executorship is issued by the Master of the High Court when the gross value of a deceased estate exceeds R250 000, and it appoints an executor with full powers to administer the estate under the Administration of Estates Act. A Letter of Authority is issued under section 18(3) of the same Act for smaller estates (under R250 000), allowing for a simplified, quicker administration process without the need for security in most cases.

There is no fixed timeline, but a straightforward estate typically takes between 12 and 24 months from reporting to the Master to final distribution. Estates with property to transfer, disputes among heirs, outstanding debts, or estate duty considerations can take considerably longer. The process includes reporting the estate, obtaining Letters of Executorship/Authority, advertising for creditors, drafting the Liquidation and Distribution account, and finally distributing assets to heirs.

If there is no valid will, the estate is distributed according to the Intestate Succession Act. Broadly, a surviving spouse and children inherit according to a set formula, and if there is no spouse or descendants, the estate passes to parents, then siblings, and further relatives in a defined order. An executor still needs to be appointed to administer the estate even where there is no will.

A conveyancer is an attorney specialising in the legal transfer of property. Only an admitted conveyancer may attend to the registration of property in the Deeds Office. Their role includes drafting and lodging the transfer documents, ensuring rates, taxes, and levies are settled, liaising with the bank, and ensuring the transfer is legally valid and correctly registered in the new owner’s name.

As a general rule, the purchaser is responsible for the conveyancing attorney’s fees and any transfer duty payable to SARS, while the seller usually appoints and pays a separate attorney to attend to the cancellation of their existing bond, if any. These responsibilities can be varied by agreement between the parties in the sale agreement.

This depends on the matrimonial property regime. In community of property, the joint estate is generally split equally. In out of community without accrual, each spouse keeps their own estate. In out of community with accrual, the growth in each spouse’s estate during the marriage is shared according to the accrual formula. A court may also make maintenance and custody orders as part of the process.

It isn’t a strict legal requirement, but it’s strongly advisable. Even an uncontested divorce involves drafting a settlement agreement covering assets, maintenance, and arrangements for children. An attorney helps ensure the agreement is fair, complete, and correctly drafted so it can be made an order of court without complications.

An antenuptial contract (ANC) is a legal agreement entered into before marriage that determines how assets will be treated during the marriage and if it ends. It must be signed before a Notary Public and registered in the Deeds Office, and it must be finalised before the wedding date — it cannot be signed or registered after the marriage has taken place.

If no ANC is signed and registered before the wedding, the marriage is automatically “in community of property” by default under South African law. This means both spouses’ assets and liabilities (from before and during the marriage) are merged into one joint estate, and both spouses generally require each other’s consent for major financial transactions. Couples who want a different arrangement must sign an ANC before the wedding — it cannot be corrected afterward without a formal, court-sanctioned postnuptial process, which is far more costly and not guaranteed to be granted.
